This website is operated by A.K. MermAid Accessories. Throughout the site, the terms “we”, “us” and “our” refer to A.K. MermAid Accessories. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

1. Scope and Agreement

This website is an e-commerce platform selling hair textile accessories.

Users agree to use the site lawfully. Fraudulent use, unauthorized content reproduction, or identity theft is strictly prohibited.

These Terms & Conditions (the "Terms") apply to all users of our website and all purchases made via our Shopify store. By placing an order, you confirm that you are at least 18 years old and agree to these Terms.

2. Order Process & Conclusion of Contract

Invitation to Treat 

The presentation of products in our online shop does not constitute a legally binding offer, but rather a non-binding online catalog (an "invitation to treat").

Your Offer

By clicking the "Place Order" (or "Complete Purchase") button, you are placing a binding order for the goods contained in your shopping basket. This action constitutes your legal offer to purchase the products from us.

Acknowledgement of Receipt

Immediately after submitting your order, you will receive an automated email acknowledging that we have received your request. Please note: This automated email is only an acknowledgement of receipt and does not yet constitute a binding acceptance of your offer.

Conclusion of Agreement

A legally binding contract between you and A.K. MermAid Accessories is only concluded when we expressly accept your order. This acceptance happens when we send you a separate "Order Confirmation" or "Shipping Confirmation" email.

Right of Refusal

We reserve the right to decline your offer at our discretion at any time prior to the Conclusion of Agreement. Common reasons for refusal include, but are not limited to:

  1. The product is out of stock (e.g., due to a failed delivery from our suppliers).
  2. We identified a manifest error in the price or description of the product.
  3. We are unable to obtain authorization for your payment.

Processing Times

Standard processing and dispatch take 1 to 3 business days.

Language of the Contract

The website is available in English. The language for the conclusion of the contract is English. In the event of any discrepancy between the English version of these Terms and Conditions and any translation into another language, the English version shall prevail and be the binding text.

3. Prices and Payments

Prices and Taxes

Prices listed are total and currently inclusive of a surcharge equal to the prevailing VAT rate. Shipping costs are stated separately. 

  1. EU Customers: In accordance with Cyprus and EU law, all prices listed are currently inclusive of a surcharge equal to the prevailing VAT rate.
  2. Non-EU Customers: If you are ordering from outside the European Union, you are responsible for any local import duties, customs fees, or taxes that may be applied by your country's authorities upon arrival.

Prices do not include shipping costs, which will be calculated and displayed at checkout before you confirm your order.

Shipping Fees

Calculated at checkout based on destination and shipping tier. Local duties outside the EU remain the buyer’s responsibility.

Price Changes and Errors

We reserve the right to update our prices at any time. In the event of a manifest pricing error (e.g., a technical glitch), we are not obligated to provide the product at the incorrect price, provided the contract has not yet been concluded.

Discount Transparency

When a price reduction is announced, we will display the "prior price," which is the lowest price applied to that product during a period of at least 30 days prior to the application of the price reduction.

Payment Methods

We accept payments via Shopify Payments (supporting Visa, Mastercard, etc.). Your data is encrypted and handled according to PCI-DSS standards. Payment is due in full at the time of order placement.

Retention of Title

All goods remain the sole property of A.K. MermAid Accessories until we have received full payment of the purchase price and any applicable shipping fees.

4. Right of Withdrawal

Under EU law, you have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period will expire 30 days from the day on which you, or a third party nominated by you, acquires physical possession of the goods.

To exercise this right, you must inform us of your decision by a clear statement via email to hello@mermaidheadband.com. You may use the attached Model Withdrawal Form, but it is not obligatory.

Effects of Withdrawal & Diminished Value:

  1. Refunds: We will reimburse all payments received from you, including the costs of standard delivery, within 14 days of receiving your withdrawal notification. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them back.
  2. Return Shipping: You are responsible for the direct cost of returning the goods.
  3. Condition of Goods: You are only liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics, and functioning.
  4. Diminished Value: Items that show clear signs of use in water (salt, chlorine, or fresh) or damage beyond a simple "try-on" will be subject to a deduction from the refund reflecting the diminished value (up to 100%).

5. Shipping and Delivery

Delivery Areas

We ship from our studio in Cyprus to all European Union (EU) member states and USA. If your country is not listed at checkout, please contact us at hello@mermaidheadband.com to see if we can arrange a custom delivery.

Shipping Costs & Methods

  1. Carrier: All international and local orders are dispatched via Cyprus Post.
  2. Tracking: Once your order has been dispatched, you will receive a shipping confirmation email containing a tracking number.
  3. Calculation: Shipping costs are calculated based on the weight of your order and the destination. The final shipping price will be clearly displayed at checkout before you finalize your payment.

Delivery Timelines

  1. Processing Time: Orders are typically processed and dispatched within 1–3 business days.
  2. Delivery Guarantee: In accordance with EU law, if we fail to deliver your items within 30 days of the order confirmation (unless a longer period was expressly agreed upon), you have the right to cancel your order and receive a full refund.
  3. Customs and Import Delays: Please note that A.K. MermAid Accessories is not responsible for any shipping delays caused by customs clearance procedures in the destination country.
  4. Customs Processing: While we aim to process all orders promptly, the time required for customs inspections and administrative processing is entirely outside of our control.
  5. International Shipping: For orders shipped outside the European Union, the recipient is the importer of record and must comply with all local laws and regulations.
  6. Estimated Delivery (Post-Dispatch):
      • Cyprus: 1–3 business days.
      • EU Countries: 5–10 business days.
      • USA: 10–20 business days.

Transfer of Risk

The risk of loss or damage to the goods passes to you (the consumer) at the moment you, or a third party designated by you (other than the carrier), takes physical possession of the items. We remain responsible for the goods until they are safely in your hands.

Customs, Duties, and Taxes

  1. EU Orders: In accordance with Cyprus and EU law, all prices listed are currently inclusive of a surcharge equal to the prevailing VAT rate. No additional customs duties apply for shipments within the EU.
  2. USA Orders: As a token of our appreciation for your loyalty, A.K. MermAid Accessories will now cover all import duties and taxes on orders shipped to the United States. That means no hidden costs or unexpected fees at delivery – just a smooth, worry-free shopping experience!
  3. International Orders (UK, JAPAN, etc.): When ordering from outside the EU, you are considered the "Importer of Record." Your order may be subject to import duties, taxes, and customs clearance fees levied by the destination country.
  4. Responsibility: These additional charges are the sole responsibility of the customer. A.K. MermAid Accessories has no control over these charges and cannot predict their amount. We recommend contacting your local customs office for further information before placing an order.

Undeliverable Packages 

If a package is returned to us due to an incorrect address provided by the customer or failure to collect the package from a local post office/access point, we reserve the right to charge for the cost of re-shipping. If you choose a refund instead, the original shipping cost will be deducted from your total.

6. Legal Guarantee

Every product sold to a consumer in the EU is covered by a 2-year legal guarantee against manufacturing defects and lack of conformity.

  1. Our Commitment: If a product fails during normal use and care instructions were followed, we will repair, replace, or provide a full or partial refund.
  2. User Responsibility: You must follow the provided Product Care Instructions. Damage resulting from "sun-bleaching," "salt-water corrosion" due to lack of rinsing, or mechanical damage (e.g., snags from Velcro or reef contact) does not constitute a manufacturing defect and is not covered under this guarantee.
  3. Reporting a Fault: If you receive a damaged item or a fault develops, please contact us immediately at hello@mermaidheadband.com with your order number and a photo of the defect. We will assess the claim in accordance with your statutory rights.

7. Intellectual Property

All designs, images, logos, copy, and visual content on this website are the property of A.K. MermAid Accessories are protected by international copyright laws. Unauthorized reproduction is strictly prohibited.

8. Products Details & Images

Products may have an associated image or photo. These are for reference only and should be considered illustrative. Product may vary from the corresponding image exhibited. We make every effort to display colors accurately, but we cannot guarantee that your device's display reflects the color of the products accurately.

Product images may differ from the actual product. Due to differences in monitors, colours of products may also appear different to those shown on the site. 9. Limitation of Liability

Inherent Risk: Our products are designed as textile hair accessories. Scuba diving and water sports are inherently high-risk activities. A.K. MermAid Accessories is not liable for accidents, injuries, or equipment failure resulting from the user's participation in these activities or the improper placement of the headband in a manner that interferes with diving gear (e.g., mask seals or regulators).

Product Care: We are not liable for damage resulting from improper care, such as "sun bleaching" beyond normal wear-and-tear, or damage caused by sharp equipment or reef contact.

Statutory Rights: Nothing in these Terms shall limit or exclude your mandatory statutory rights as a consumer under EU law regarding defective or unsafe products.

10. Data Protection

Personal data collected is treated strictly in accordance with the General Data Protection Regulation (GDPR) and local data privacy laws. Full details are accessible in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Republic of Cyprus. 

In the event of a dispute, the parties submit to the courts of the consumer’s domicile. The European Commission provides a platform for online dispute resolution, which you can access here: https://ec.europa.eu/consumers/odr.

12. Relationship with Shopify

MermAid - Headbands For Divers is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with MermAid - Headbands For Divers. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MermAid - Headbands For Divers, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MermAid - Headbands For Divers.
